IMI : (Imposto municipal sobre imóveis)

IMI : (Imposto municipal sobre imóveis)

This tax is an annual tax calculated on the patrimonial value of each property.

You should know that IMI is due by the person who owns the property on 31/12 of each year and the buyer is the person who will receive, in the following year, the IMI of the previous year to be paid.  It is not usual in Portugal, to share the payment of the IMI to the prorata of the current year between sellers and buyers. Still, this may be negotiable.

The patrimonial value is given by the finances and it is usually much lower than the acquisition value. You can find the patrimonial value of the property in the caderneta predial of the same or in your portal of finances in the section "Patrimony". The Tributary Patrimonial Value is, basically, the fiscal value of the property.

The calculation is :
IMI = Tributary Patrimonial Value x municipality ratio

Knowing that, each year, you will pay the IMI following these rules :
- If the IMI is not more than 100 euros, the payment must be made at once;
- If the amount is between 100 and 500 euros, the citizen can choose to pay in two payments, during the months of May and November;
- If the amount is over 500 euros, then it is possible to pay the IMI in three monthly payments, during the months of May, August and November.

It is also possible to have a temporary exemption of IMI payment in case of a property acquired for own and permanent habitation, if the Patrimonial Value is not superior to 125 thousand Euros and if the collectable income of the family unit is inferior to 153.300 thousand Euros for IRS purposes, then the family can have exemption of IMI payment during three years.

For the calculation of IMI, the ratio to be applied is defined by each municipality in Portugal, for urban buildings (houses for habitation and land for construction) :

This is an annual tax calculated based the taxable patrimonial value of each property.

IMI is due by the owner of the property on 31/12 of each year and the owner only pays the IMI of the previous year, the following year.

Regarding the buyer, it is not customary in Portugal to share the pro rata IMI payment of the current year between sellers and buyers. Still, it may be negotiable.

The taxable patrimonial value is attributed by the Tax Authority and it is usually much lower than the acquisition amount. You can find the taxable patrimonial value of the
property in its caderneta predial (property tax booklet) or via your Online Tax Portal in the section Património. The Taxable Patrimonial Value is, basically, the fiscal value of the property.

The calculation is :

IMI = Taxable Patrimonial Value x Municipality Rate

- If the IMI does not exceed 100 euros, the payment must be made in one installment;

- If the amount is between 100 and 500 euros, the citizen can choose to pay in two installments, in May and November;

- If the amount is over 500 euros, then it is possible to pay the IMI in three monthly installments, in May, August and November.

It is also possible to acquire a temporary IMI exemption in case of a property acquired for primary residence, if the taxable patrimonial value is not to over 125,000.00 Euros and if the taxable income of the household is under 153,300.00 Euros for IRS (Tax Return) purposes. In this case, the family can benefit from IMI exemption for three years.

The IMT is the Property Transmission Tax and is one of the taxes to be paid when purchasing your property.

This tax is due by the buyer and is the most expensive tax when purchasing a property, being a one-off payment.

The amount of this tax is not the same in all cases. It varies according to the property acquisition amount, location, and purpose (for example, if it is for primary residence, secondary residence, commerce, tourism resort, ....).

There are some exceptions to IMT payment, namely properties for primary residence with an acquisition amount or taxable patrimonial value (the highest value is considered) lower than 92 407 euros;

This tax must be paid by the buyer before or at the time of the deed. There are some notaries that can issue the payment guides on the day of the deed, however, not all of them do it, so you have to be careful and make sure before the deed day.

Without the payment and the proof of payment, the deed will not take place
