Do you want to sell or to rent your property ?

Since 1 January 2024, Portugal has implemented Decree-Law no. 10/2024, known as the "Simplex for Urban Licensing".
This reform aims to simplify administrative procedures in the real estate and planning sectors.

Official source: Decree-Law no. 10/2024 – DRE

✅ What the law changes

At the time of sale:

  • It is no longer mandatory to provide the Licença de Utilização (Usage Licence)

  • It is no longer mandatory to provide the Ficha Técnica da Habitação (Technical Property Certificate)

In short, these documents are no longer required to sign the final deed of sale.

Goal of Simplex 2024: reduce bureaucracy, simplify processes and speed up property transactions.

⚠️ What the law doesn’t cancel

The reform does not change:

  1. Bank requirements – banks may still ask for these documents to grant a mortgage.

  2. ️ Insurance requirements – insurers may require proof of compliance.

  3. Urban planning laws – the legal use of the property (residential, commercial, etc.) must still match the registered use.

Specific case: Alojamento Local (Short-term rental licence)

⚠️ Buying a property without a usage licence may prevent you from obtaining an AL licence.

  • The Municipal Council (Câmara Municipal) will only approve AL if the property is legally classified as residential.

  • Without a usage licence, your application may be refused or require legalisation.

  • The council may also carry out an on-site inspection before granting the AL registration.

Warning

Simplex 2024: Selling a property without a licence or technical data sheet is now possible
